Lush Haircare South Africa (Pty) Ltd a registered company as per the laws of Republic of South Africa (Registration No. 2022/369001/07) (Hereinafter referred to as “Be beautiful”, “we” or “us”), operates via Shopify.
These general Terms and Conditions are applied to all visitors of the website as well as any business transactions through this online store. The website navigation and purchase of any product in our website imply acceptance of all the following points.
Lush Haircare South Africa (Pty) Ltd reserves the right to change these conditions without notice, and any changes will be published in our website.
Online registration
Registration as a purchaser on the website is free and does not oblige you to purchase anything. You must register with us before placing your first order online. Please register here.
Registration and/or use of Be Beautiful website constitutes your acceptance and agreement to be bound by the terms of Be Beautiful website.
To register you will be required to provide certain personal information which is protected by our privacy policy. When registering with us you will be required to provide an email address and password which will be used as your username and password for the website.
Please keep your password private as Be Beautiful accepts no liability for any damage suffered or losses incurred from the use or misuse of your account.
You will be required to enter your username and password each time you visit Be Beautiful website. To amend any registration particulars please click “My profile” where you can edit your details.
When registering as a purchaser you are required to provide Be Beautiful with complete and accurate information about yourself. By doing so you warrant that the information provided is correct. Upon acceptance of your registration an email confirmation of your registration as a purchaser will be transmitted to you. Transmission times depend on your internet service provider (ISP), but it typically takes less than 10(ten) minutes to receive the email confirmation. If you do not receive the email confirmation, you should contact us.

Products, Images and Representation
We have made every effort to display the products on the website as accurately as possible, including:
- The images that represent a visual depiction of the product
- Features and descriptions that pertain to the product
The actual product delivered may be subject to variations in appearance as product packaging may differ over time. It remains the responsibility of the customer to ensure that the product he/she ordered is correct, and the product description and/or model number will always overrule any related images when resolving a dispute about a product.
As the actual colours you see will depend on your computer’s monitor, Be Beautiful cannot guarantee that your monitor’s display of any colours will be accurate.
Product Pricing, Availability and Delivery
The products displayed on the website are subject to availability and will be delivered within the Republic of South Africa only, within the areas as determined by Be Beautiful. Available delivery areas are identified at the checkout process when the delivery address is entered, and it remains the responsibility of the customer to ensure the delivery address, including the suburb and postal code, is correct.
All prices displayed on the website are valid and effective only in the Republic of South Africa for the day that they are viewed and do not constitute an offer by any of our physical distribution stores. Be Beautiful reserves the right, without prior notice, to discontinue or change pricing or specifications of products and services offered in this website without incurring any liability whatsoever. In an event of a pricing error, we reserve the right to cancel any orders resulting from such pricing errors.
Be Beautiful cannot guarantee availability of stock but will endeavour to source stock where possible to fulfil your order. Where items cannot be delivered, Be Beautiful will endeavour to contact the customer based on information provided at registration, and offer either the option to cancel the order or reduce the quantities, where applicable. If Be Beautiful is unable to supply each and every item ordered or in the quantities ordered and cannot contact the customer, the customer nevertheless agrees to accept delivery and make payment for the items correctly delivered.

Our Shipping prices are mentioned on Shipping policy, which are applicable as per selected method of shipping at the time of check out.
These shipping charges are function of market related rates provided by service providers, which may change as per market forces. Any change in our shipping charges will be updated on our website
Tracking
All orders shipped have a tracking number connected to it, these tracking numbers are sent by email or text messages as soon as your order is shipped.
We constantly work with our shipping service vendors to provide best in class shipping experience to our customers. All our shipping partners provide live tracking of the packages.

Applicable taxes and levies
All our prices are compliant with regulations of Republic of South Africa. All invoices shared with customers are compliant as per law and carry applicable details of taxes & levies.
Cancellation Policy
Once an order is confirmed and paid for unfortunately it is not possible to cancel the order. If you wish to cancel your order a Cancellation fee equivalent to 10% (ten percent) of your total order amount will be applied to orders cancelled before it has been dispatched. This fee covers part of the handling and processing costs incurred by our team.
Return Policy
Within 10 (ten) business days after receiving the order, if you are dissatisfied with your product due to damages, defectives or an incorrect product and you want to return any item, please send an email to us with:
- The order number, tracking number, and waybill number
- The items name you wish to return.
- The reason for return.
- Photographic evidence of defect, damaged or incorrect product.
Within 2(two) business days of sending your return/refund email, our customer care team - bebeautifulsouthafrica@gmail.com will review your request and send you all the return instructions. Upon receiving of the return, the product will be investigated and validated. If the product is aligned with the return policy/requirements a credit or an exchange will be issued.
Credit will be issued/processed between 21 (twenty –one) business days of when the email was sent.
Refunds can be made in the following situations:
- Cancelled orders (before shipment);
- Orders returned to us and
- Returns (returnable items);
- Validated complaints of damaged, wrong, missing or expired products reported in a maximum of 10 (ten) days after order's delivery.
Products eligible for return
- Unopened, unused and sealed in their original packaging, including the protective cellophane or labels (if any)
- Damaged/broken during transportation
- Products purchased in promotion
- Not what your Ordered
Products ineligible for return
- Giveaways received during promotions e.g. including but not limited to bonnets, nail clipper set, t-shirts, pens, notepads
- Open & used products
- Issue with the products detected after the 10(ten) days of being delivered have passed.
Returning shipping and charges
Shipping fees to return the items are at the customer's own expense
Failed Delivery
Orders shipped but not delivered
If an order gets returned to us due to unknown recipient, wrong or incomplete address, unclaimed order, delivery refused
- We can Ship the order again to new details - Customer needs to pay for shipping
- Money refund will have shipping cost deduct to offset the expenses borne by the company

Returned Orders due to issues unrelated with the customer are reshipped with no extra cost or refunded totally, depending on the customer’s preference.
If we fail to deliver your order within the specified time period reflecting on the confirmation email, you may request for a full refund without any cancellation fees.
Rules for Returns
For the return to be accepted, it is essential to respect the following rules:
The product must be sealed in its original packaging, including the protective cellophane or labels (if any);
If the product box has mark or seal, the seal or any other protection marks must be kept intact;
The product has to be with all items: samples, gifts, among others, respecting the original shipping conditions;
Refunds
Refunds can be made in the following situations:
- Cancelled orders (before shipment);
- Orders returned to us and
- Returns (returnable items);
- Validated complaints of damaged, wrong, missing or expired products reported in a maximum of 10 days after order's delivery.
Your refund will be processed within 21 (twenty –one) business days. It will be automatically issued to the original account used to make the purchase.

Limitation of liability - Indemnity
The Client hereby indemnifies Be Beautiful for damages caused by intent or gross negligence for loss of life, bodily harm or damage to health.
Be Beautiful is not liable for other damages than in the case of concealment of defects, for claims on the product itself. Even if these were caused through slight negligence, Be Beautiful is liable for damages, limited to the replacement of the damaged goods.
Copyright
Be Beautiful claims all copyrights for the content of the website as well as for any artwork elaborated on the site, including text, symbols and pre-loaded images.
Agreement Changes
If the validity of this agreement, or parts of it, can no longer be guaranteed, or if there is the need to make changes as required by law or by other competent authorities, the entire agreement can still be considered valid, although at times we reserve the right to make reasonable adjustments to these terms. The Customer is subject to the terms applicable from time to time when using the service.
Jurisdiction Law
These conditions are governed and shall be interpreted under the laws applicable in South Africa.
